By entering or using this “Product” herein means any product developed and/or managed by Agartha in any way, you agree and be bound by the terms and conditions set forth herein and any changes that may be posted at a later date (together , "Terms of use"). We will announce any changes of this kind on the home page of our website and within our products, a few days before they become effective, if you do not agree with all of the terms and conditions in the Terms of Use, please do not enter or use this product.
The terms of use, guidelines and other rules posted on this product may change from time to time and your continued access to or use of the product constitutes your acceptance of such changes to the current version. Terms of use
1. Accounts : You need an account for most activities on our platform. Keep your password in a safe place, as you are responsible for all activities associated with your account. You need an account for most activities on our platform, including purchasing and accessing content or submitting content for publication. When setting up and maintaining your account, you must provide and continue to provide accurate and complete information, including a valid email address. You may not share your account login details with anyone else. We may ask you for some information to confirm that you are indeed the owner of your account.
2. Content registration and access to content for a period of three years:
When you register for a course, you obtain a license from us to view it through the services of Agartha Academy and not for any other use. Do not attempt to transfer or resell the Content in any way. We generally grant you an access license for three years from the date you registered the Content, except when we have to disable the Content for legal or policy reasons, or for registrations via subscription plans.
Under our Instructor Terms, when teachers post content to Agartha Academy, they grant Agartha Academy a license to provide a license to the Content to students. This means that we have the right to license content to registered students.
As a student, when you register for a Course or other content, whether free or paid content, you are acquiring a license from Agartha Academy to display the Content via our Agartha Academy platform, and Agartha Academy is the licensee of the record. The content is licensed to you and is not sold to you. This license does not give you any right to resell the Content in any way (including sharing account information with the purchaser or illegally downloading and sharing Content on other sites or platforms).
Subject to the Legal Terms, Agartha Academy grants you (as a Student) a limited, non-exclusive, non-transferable license to access and display the Content for which you have paid all applicable fees, solely for your personal, non-commercial, educational purposes through the Site, non-transferable and exchangeable with another person, Subject to these Terms and any terms or limitations associated with a particular content or feature of our Services. All other uses are prohibited. You may not reproduce, redistribute, transfer, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works from, sublicense, transfer or otherwise use any Content unless we give you our express permission To do that. We generally give a three-year access license to our students when they enroll in a course. We give a one-year access license for the annual subscription to the site, and a six-month access period for the subscription. However, we reserve the right to revoke any license to access and use any Content at any time if we decide or are obligated to disable access to the Content for legal or political reasons, for example, if a course or other Content you have registered for is the subject of a complaint regarding copyright, or if we determine that it is in violation of our Trust and Security Guidelines. This Lifetime Access License does not apply to registrations via Subscription Plans or to additional features and services associated with a Course or any other content that you enroll in. For example, educators may decide at any time not to provide educational assistance or question-and-answer services in linking to the Content. To be clear, lifetime access is to the course content and not to the instructor.
Teachers may not grant licenses to their content to students directly, and any such direct license is null and void and in violation of these Terms.
3.Payments, credits and refunds
When you make a payment, you agree to use a valid payment method. If you're not satisfied with your content, Agartha offers a 30-day refund or credit for most content purchases.
3.1 Pricing
Prices for content on Agartha are set based on the terms of the Coach Terms and our Promotions Policy. In some cases, the price of content displayed on the Agartha Website may not be exactly the same as the price displayed on our mobile applications or advertising mediums, due to the mobile platform providers' pricing systems and their policies regarding the implementation of sales and promotions.
We occasionally run promotions and sales of our content, during which certain content is available at discounted prices for a specified period of time. The price applicable to Content will be the price at the time you complete your Content purchase (at checkout). Any price displayed for certain Content when logged into your account may also differ from the price available to unregistered or unsigned users, as some of our promotions are only available to new users.
If you are logged into your account, the listed currency you see is based on your location when you created your account. If you are not logged into your account, the rate currency depends on the country you are in. We do not enable users to see prices in other currencies.
If you are a student who resides in a country where Use and Sales Tax, Goods and Services Tax or Value Added Tax (VAT) applies to consumer sales, we are responsible for collecting that tax and remitting it to the appropriate tax authorities. Depending on your location, the price you see may include such taxes, or the tax may be added at checkout.
3.2 Payments
You agree to pay the fees for the Content that you purchase, and you authorize us to charge your debit or credit card or to process other payment methods (such as Boleto, SEPA, direct debit, or mobile wallet) for those fees. Agartha works with payment service providers to offer you the most convenient payment methods in your country and to keep your payment information secure. We may update your payment methods using the information provided by our payment service providers. Check our Privacy Policy for more details.
When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you are still able to access the content for which you are registering, you agree to pay the corresponding fee to us within thirty (30) days of notifying us. We reserve the right to disable access to any content for which we have not received sufficient payment.
3.3 Refunds and Redemption Credits
If the Content you purchased is not what you expected, you can request, within 30 days of your purchase of the Content, that Agartha apply a refund to your account. This redemption option does not apply to subscription plan purchases, which are covered in Section 8.4 below. We reserve the right to apply your refund as a refund or refund to the original payment method, at our discretion, depending on the capabilities of our payment service providers, the platform on which you purchased your Content (website, mobile application or advertising), and other factors. If we decide to issue refunds to your account, they will be automatically applied to the next content purchase on our website, but cannot be used for purchases in mobile applications or marketing sites. Redemption credits may expire if not used within the specified period and have no value cash, in each case unless otherwise required by applicable law.
At our discretion, if we believe you are abusing our refund policy, such as if you have consumed a significant portion of the content you want to refund or if you have previously refunded content, we reserve the right to refuse your refund, limit you from other refunds in the future, and block Your account and/or limit all future use of the Services. If we block your account or disable your access to content due to your violation of these Terms or our Trust and Security Guidelines, you will not be eligible for a refund. 3.4 Gift and promotion codes
Agartha or our partners may offer gifts and promotional codes to students. Certain codes may be redeemed for gift or promotional credits applicable to your Agartha account, which can then be used to purchase eligible content on our platform, subject to the terms included in your codes. Other codes may be directly redeemable for certain content. Gift Credits cannot be used to promote purchases in mobile applications or marketing sites
These codes and credits, as well as any promotional value associated with them, may expire if they are not used within the period specified in your Agartha Account. Gift and promotion codes offered by Agartha may not be redeemed for cash, unless otherwise stated in the terms included in your codes or as required by applicable law. Partner gift and promotion codes are subject to that partner's refund policies. If you have multiple credits saved, Agartha may determine which of your credits apply to your purchase. Check our support page and any terms included in your codes for more details.
4. Rules of Content and Conduct
You may only use the Agartha website for lawful purposes. You are responsible for all content that you post on our Platform. You must keep reviews, questions, posts, courses, and other content that you upload in line with our Trust and Security Guidelines and the law, and respect the intellectual property rights of others. We can ban your account for repeated or major violations. If you think someone is violating your copyright on our platform, let us know.
You may not access or use the Services or create an account for illegal purposes. Your use of the Services and conduct on our Platform must comply with applicable local or national laws or regulations in your country. You are solely responsible for knowing and complying with these laws and regulations that apply to you.
If you are a student, the Services enable you to ask questions to instructors of courses or other content you have signed up for, and to post content reviews. For specific content, the instructor may invite you to submit content as "homework" or quizzes. Do not post or send anything that is not yours.
If you are a teacher, you can submit content for publication on the platform and you can also communicate with students who have enrolled in your courses or other content. Either way, you must comply with the law and respect the rights of others: You may not post any course, question, answer, review, or other content that violates local or national laws or regulations in your country. You are solely responsible for any courses, content and actions you post or take through the Platform and the Services and their consequences. Make sure you understand all copyright restrictions set forth in the Coach Terms before submitting any content for publication on Agartha.
If we are notified that your Course or Content violates the law or the rights of others (for example, if it is proven to infringe the intellectual property or image rights of others, or relates to illegal activity), if we discover that your Content or behavior violates our Trust Guidelines and our own security, or if we believe that your content or behavior is unlawful, inappropriate or objectionable (for example if you impersonate someone else), we may remove your content from our platform. Agartha complies with copyright laws. Check our intellectual property policy for more details.
Agartha has the discretion to enforce these Terms and our Trust and Safety Guidelines. We may limit or terminate your permission to use our Platform and Services or block your account at any time, with or without notice, for any reason or no reason, including for any violation of these Terms, if you fail to pay any fees when due, for fraudulent chargebacks, At the request of law enforcement or government agencies, for extended periods of inactivity, or for unexpected technical problems or problems, if we suspect that you are engaging in fraudulent or illegal activities, or for any other reason in our sole discretion. Upon any such termination, we may delete your account and content, and may prevent you from accessing the Platforms and using our Services. Your Content may remain available on the platforms even if your account is terminated or suspended. If a user posts content that infringes your copyright or trademark rights, please let us know. Our Coach Terms require our instructors to follow the law and respect the intellectual property rights of others. 5. Agartha's Rights in Your Content
You retain ownership of the content that you post on our Platform, including your Courses. We are permitted to share your content with anyone via any media, including promoting it via advertising on other websites.
The content that you post as a student or teacher (including courses) remains your property. By posting courses and other content, you allow Agartha to reuse and share it but you do not lose any ownership rights you may have over your content. If you are an instructor, make sure you understand the content licensing terms detailed in the Instructor Terms.
When you post content, comments, questions, and reviews and when you send us ideas and suggestions for new features or improvements, you authorize Agartha to use, share with anyone, distribute and promote that content on any platform and in any media, and make modifications or modifications to it as we see fit.
In legal language, by submitting or posting Content to or through the Platforms, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute your Content (including including your name and photo) in any and all media or distribution methods (existing or later developed). When you interact directly with a student or teacher, you need to be careful about the types of personal information you share. While we restrict the types of information teachers may request from students, we do not control what students and teachers do with information they obtain from other users on the Platform. You should not share your email or any other personal information about yourself for your own safety.
We do not hire or employ instructors and are not responsible or liable for any interactions between instructors and students. We are not responsible for disputes, claims, losses, injuries or damages of any kind that may arise from or relate to the conduct of teachers or students.
When you use our Services, you will find links to other websites that we do not own or control. We are not responsible for the content or any other aspect of these third party websites, including their collection of information about you. You should also read their terms and conditions and privacy policies.
7. Rights of Agartha
We own the Agartha platform and services, including the current or future website, applications, services, things like our logos, application programming interface (API), code, and content created by our employees. You cannot tamper with it or use it without permission.
All right, title, and interest in and to the Agartha Platform and its services, including our website, current or future applications, APIs, databases, and content that our employees or partners provide or provide through our Services (but excluding content provided by teachers and students) are and shall remain the exclusive property of Agartha and its licensors. its affiliates. 8. Terms of Subscription

8.1 Subscription plans
While you are subscribed to a Subscription Plan, you obtain a limited, non-exclusive, non-transferable license from us to access and display the Content included in this Subscription Plan via the Services. The subscription you purchase or renew determines the scope, features, and price of your access to the subscription plan. You may not transfer, assign or share your Subscription with anyone else.
We reserve the right to revoke any license to use Content in our subscription plans for legal or policy reasons at any time and in our sole discretion, for example, if we no longer have the right to display Content through a subscription plan. 8.2 Account Management
You can cancel your subscription by following the steps outlined on our support page. If you cancel your subscription to a subscription plan, your access to that subscription plan will automatically expire on the last day of the billing period. Upon cancellation, you will not be entitled to a refund or credit of any fees already paid for your Subscription, unless otherwise required by applicable law. To be clear, opting out does not terminate your Agartha account.
8.3 Free trials and renewals
Your subscription may start with a free trial. The duration of the free trial period for your subscription will be determined during registration. Agartha determines eligibility for a Free Trial at our sole discretion and may limit eligibility or duration. We reserve the right to terminate your free trial period and suspend your subscription if we determine that you are ineligible.
8.4 Payments and Invoices
The subscription fee will be included at the time of purchase. You can visit our support page to learn more about where to find the fees and dates applicable to your subscription. We may also be required to add taxes to your subscription fee
To subscribe to the subscription plan, you must provide a payment method. By signing up for a Subscription Plan and providing your billing information during checkout, you grant us and our Payment Service Providers the right to process payment for the then-applicable fees via our registered payment method. At the end of each subscription period, we will automatically renew your subscription for the same term and process your payment method to pay the applicable fees at that time.

We reserve the right to change our subscription plans or modify the prices of our services at our sole discretion. Any changes or price changes to your Subscription will be effective upon notice to you, except as required by applicable law.
We will collect the annual and semi-annual subscription fees. Your subscription will automatically renew according to your subscription settings (eg semi-annual or annual) unless you cancel your subscription before the end of the period.

Even if we are late in exercising our rights or fail to exercise a right in one instance, that does not mean that we are waiving our rights under these Terms, and we may decide to enforce them in the future. If we decide to waive any of our rights in a particular situation, it does not mean that we waive our rights generally or in the future.

10. Dispute Resolution

10.1 Go to arbitration

10.3 No Class Actions
We both agree that we can only file claims against the other on an individual basis.
